3. Location Information: We may collect your location information to help you find the nearest dental office that partners with reemarc that provides clear aligner orthodontic services to you.
4. Device Information: We may collect information about the device you use to access our platform, such as the type of device, the operating system, and the browser you use.

How We Use Your Information

1. Providing Our Services: We use and access your personal information, including your dental records from your dentist or orthodontist or any photos you have uploaded to the Platform in order to provide you and your dentist or orthodontist with our services. Our services include, among others, connecting you with dental offices near you that partners with reemarc so you can make an appointment, start your treatment through the partner dental office and to track the progress of your treatment such as the status of shipment of your clear aligner ordered by your dentist or orthodontist and other instructions related to your treatment as provided by your dentist or orthodontist.
2. Improving Our Services: We may use your usage and device information to improve and enhance our platform, such as by personalizing your experience, optimizing our website, and developing new features.
3. Communicating with You: We may use your contact information to send you updates, notifications, and other information related to our services.
4. Complying with Legal Obligations: We may use your information as necessary to comply with applicable laws, regulations, and legal processes.

Sharing Your Information

1. Data Sharing with Affiliates: We may share your personal information and data with our affiliated companies and subsidiaries to provide you with our services and features and to improve and enhance our services. The affiliated companies are bound by the same privacy and security standards as reemarc and are prohibited from using your personal information or data for any purpose other than those described in this section. 2. Service Providers: We may share your information with third-party service providers who assist us in operating our platform and providing our services, such as hosting providers and payment processors, as applicable.
3. Partner Dental Offices: We may share your location and contact information with physical dental offices near your work or home to facilitate your access to orthodontic services. A dentist/orthodontist at your Partner Dental Office may also share with us any additional information relating to your treatment.
4. Legal Compliance: We may disclose your information if required to do so by law or in our good-faith belief that such action is necessary to comply with legal obligations, protect our rights, or protect the rights of others.
5. Change of Control or Sale: In the event of a merger, acquisition, or sale of reemarc or all or a substantial portion of our assets, your personal information and data may be transferred as part of that transaction. We will notify you via email and/or a prominent notice on our website of any change in ownership or uses of your personal information, as well as any choices you may have regarding your personal information.

Data Security

We implement reasonable and appropriate security measures to protect your personal information and data from unauthorized access, disclosure, alteration, or destruction. These include measures such as encryption, access controls, and network security. However, unfortunately, we cannot guarantee the security of your personal information and data transmitted, collected or stored on or through our platform and any such transmission or storage is at your own risk.​

We retain Images for as long as necessary to provide our services and as required by applicable law, including HIPAA record retention requirements. If you would like to request deletion of your Images, please contact us at smile@reemarc.com. Deletion requests are subject to certain exceptions, such as where retention is required for legal or regulatory purposes.

Retention and Deletion

We implement reasonable and appropriate administrative, technical, and physical safeguards designed to protect your Images from unauthorized access, use, or disclosure, consistent with HIPAA and other applicable privacy and security laws.

Patient Images and Uploads

As part of providing our services, reemarc may collect and process photographs, diagnostic images, and other patient-generated content (collectively, Images) uploaded through our platform. These Images may be uploaded directly by you (the patient) or by your dentist or orthodontist on your behalf.
1. Use of Images - we use Images for purposes including, but not limited to (i) facilitating diagnostic assessments, treatment planning, and virtual consultations; (ii) communicating with your dentist or orthodontist regarding your care, (iii) tracking treatment progress (e.g., reviewing Images of your teeth for aligner fitting or progress checks); (iv) quality assurance, customer support, and platform feature development; and (v) as otherwise permitted or required by applicable law.
2. Sharing Images - we may share your Images with (i) your treating dentist or orthodontist and their dental office for treatment planning and coordination, (ii) our affiliates or service providers who assist us in providing services (subject to contractual obligations of confidentiality and compliance with HIPAA, where applicable); and (iii) as otherwise described in the "Sharing Your Information" section of this Privacy Policy.
3. Authorization - if you submit Images directly, you are providing your authorization for us to use and disclose these Images for the purposes described in this Privacy Policy, and as permitted under the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and other applicable laws.
If Images are submitted by your dentist or orthodontist, they represent to us that they have obtained any legally required consents and authorizations from you before sharing your Images with reemarc.

Children's Online Privacy Protection Act (COPPA)

Our platform is intended for users who are 13 years of age or older. We do not direct our services, content, or marketing toward children under 13.
We do not knowingly collect personal information or data from children under the age of 13. If we learn that we have inadvertently collected such information without verified parental consent, we will promptly delete that information.
Parents or legal guardians who believe that their child under 13 may have provided us with personal information can contact us at smile@reemarc.com to request deletion of that data.

California Residents

reemarc is committed to honoring the terms of the California Consumer Privacy Act of 2018 (CCPA). Under the CCPA, you have the following rights:
1. The right to know what personal information is being collected about you.
2. The right to know whether your personal information is sold or disclosed and to whom.
3. The right to say no to the sale of your personal information.
4. The right to access your personal information.
5. The right to request the deletion of your personal information.
